These Host & Local Supplier Terms and Conditions (“Host Terms”) govern the relationship between Homefans and any person or business offering or providing an experience, activity, tour, matchday service, ticket-related service, local hosting service or other service through the HomeFans platform (“Host”, “Supplier” or “you”).
By registering as a Host, creating or maintaining a listing, accepting a booking, or otherwise supplying services through the Homefans platform, you agree to these Host Terms together with the general Homefans Terms and Conditions and Privacy Policy.
HomeFans operates a platform through which independent local Hosts and Suppliers can offer football, sports, cultural and travel-related experiences and services to customers.
Unless expressly agreed otherwise in writing, HomeFans does not employ Hosts and does not itself perform the local services offered by Hosts. Homefans may facilitate listings, marketing, bookings, customer communications, payments, customer support and other platform services.
The Host remains responsible for properly providing the service or experience accepted by the Host.
Hosts provide their services as independent suppliers. Nothing in these Host Terms creates an employment relationship, partnership, joint venture, franchise or general agency relationship between HomeFans and the Host.
Hosts are not employees of HomeFans and are not entitled to employee benefits, holiday pay, sick pay, pension contributions, severance or other rights arising specifically from an employment relationship.
Subject to confirmed bookings and these Host Terms, Hosts determine whether and when they wish to make their services available through HomeFans.
Unless expressly authorized in writing, a Host may not:
enter into agreements on behalf of HomeFans;
make commitments or representations purporting to bind HomeFans;
represent themselves as an employee or authorized agent of HomeFans; or
incur obligations or liabilities in HomeFans' name.
Nothing in this section overrides any mandatory rights or legal classification that applies under applicable law.
Each Host is responsible for operating their own activity or business in accordance with applicable law. This includes responsibility for, where applicable:
taxes and tax registrations;
VAT or equivalent indirect taxes;
social-security obligations;
business registrations;
licences;
permits;
professional qualifications;
insurance;
local regulations;
stadium or venue requirements; and
any other authorization required to provide the relevant service.
Hosts are responsible for maintaining their own accounting, tax, invoicing, transaction and business records.Homefans is not the Host's accountant, tax adviser or permanent business-record storage provider.
Homefans may retain records in accordance with its own legal, regulatory, tax, operational and data-retention obligations, but does not guarantee indefinite availability of historical Host records.
Information supplied by a Host must be accurate, current and not misleading. Hosts must disclose all material information customers reasonably need to understand the service being purchased.
This includes, where applicable:
meeting locations;
start times;
duration;
inclusions and exclusions;
ticket or stadium-access arrangements;
age requirements;
identification requirements;
mobility requirements;
safety considerations;
restrictions;
cancellation conditions; and
other material requirements.
Hosts must promptly correct information that becomes inaccurate.
Homefans may edit the presentation, formatting or marketing of a listing provided that this does not materially misrepresent the underlying service.
A Host is not required to accept every booking unless the Host has configured their service for automatic confirmation.
Once a booking has been accepted or otherwise confirmed, the Host is responsible for delivering the service in accordance with:
the confirmed booking;
the listing description;
communications with the customer;
these Host Terms; and
applicable law.
A confirmed booking is a professional commitment.
Hosts must not accept bookings they do not reasonably expect to be able to fulfil.
Hosts must provide services professionally, responsibly and with reasonable skill and care.
Hosts must:
arrive at the agreed location on time;remain reasonably contactable around the time of the service;
provide the service described in the booking;
treat customers respectfully;
provide reasonable assistance where difficulties arise;
comply with applicable safety requirements;
communicate material changes immediately; and
act in a manner consistent with the reasonable standards expected from a HomeFans Host.
Repeated complaints or repeated failure to meet these standards may result in restrictions, suspension or termination in accordance with these Host Terms and applicable law.
Where a service involves attending a football match, sporting event, stadium or other ticketed event, the Host must clearly understand and communicate their responsibilities.
Where the Host is responsible for supplying, arranging or facilitating access, the Host must take reasonable steps to ensure that the customer receives the agreed access.
A Host must not knowingly:
promise access that cannot reasonably be provided;
provide materially different access without informing the customer;
abandon customers at or near a stadium or venue without reasonable assistance;
fail to attend an agreed meeting point without reasonable notice;
knowingly provide invalid access credentials; or
leave a material access problem unresolved without promptly informing HomeFans.
Where access depends on third parties, clubs, venues, authorities or circumstances outside the Host's reasonable control, the Host must notify HomeFans as soon as reasonably possible.
Hosts must cooperate reasonably with HomeFans when investigating a customer complaint.
This may include providing:
the Host's account of events;
relevant communications;
proof of attendance;
ticket or access information;
receipts;
photographs;
supporting documentation; and
other information reasonably relevant to the complaint.
Hosts must not knowingly provide false or misleading information during a complaint investigation.
HomeFans may consider available evidence from the Host, customer and other relevant sources when determining an appropriate resolution.
Hosts should cancel confirmed bookings only where reasonably necessary.
Where cancellation becomes unavoidable, the Host must notify HomeFans as soon as reasonably possible.
Repeated Host cancellations, failure to attend confirmed bookings or failure to provide booked services may result in restrictions, suspension or termination.
Emergency circumstances and matters genuinely outside the Host's reasonable control will be considered where appropriate.
Where a customer receives no service, a materially deficient service, or materially different service due to an act or omission attributable to the Host, HomeFans may refund or compensate the customer where reasonably appropriate.
Where HomeFans reasonably determines, based on available evidence, that a refund, compensation payment or other direct loss resulted from the Host's failure to fulfil their obligations, HomeFans may, to the extent permitted by applicable law and these Host Terms:
deduct the relevant amount from amounts otherwise payable to the Host;
offset the amount against future Host payouts; or
seek reimbursement from the Host.
HomeFans will not hold a Host responsible for losses caused solely by circumstances genuinely outside the Host's reasonable control.
Any recovery sought from a Host should be reasonably connected to the relevant booking, incident or breach.
HomeFans may collect customer payments and facilitate payments to Hosts in accordance with the applicable booking and payment arrangements.
The amount payable to the Host will be the amount agreed or displayed through the applicable Host interface or otherwise agreed between HomeFans and the Host.
HomeFans may withhold or adjust payments where reasonably necessary to address:
cancellations;
refunds;
chargebacks;
duplicate payments;
suspected fraud;
payment errors;
unresolved customer complaints; or
amounts properly recoverable from the Host under these Terms,
subject to applicable law.
Hosts are responsible for maintaining the records reasonably necessary for their own business, accounting and tax purposes.
Hosts should not rely on permanent access to the HomeFans platform as their sole method of maintaining such records.
Where HomeFans provides dashboards, booking histories, statements or other information, availability may be subject to HomeFans' applicable retention periods, technical systems and legal obligations.
Termination or suspension of a Host account does not create an obligation for HomeFans to reconstruct records or datasets that do not exist or are no longer lawfully retained.
Nothing in this section limits any mandatory statutory right a Host may have to receive particular information.
Hosts may receive access to limited customer personal data where reasonably necessary to fulfil a booking.
Such information may include, depending on the booking:
customer name;
contact information;
booking information;
meeting information; and
information necessary to provide the booked service.
Hosts may use customer personal data only for legitimate purposes connected with providing the relevant service or complying with applicable law.
Hosts must not:
create an independent customer marketing database from HomeFans bookings;
sell customer data;
disclose customer data without authorization;
use customer information for unrelated marketing;
retain customer information longer than reasonably necessary;
contact former customers for inappropriate or unrelated purposes; or
use customer information following termination except where legally required.
Hosts must take reasonable measures to protect customer information from unauthorized access, loss, disclosure or misuse.
Any suspected personal-data breach involving HomeFans customers must be reported to HomeFans without undue delay.
Hosts may obtain confidential or commercially sensitive information through their relationship with HomeFans.
This may include:
internal pricing;
margins;
supplier arrangements;
operational procedures;
non-public customer information;
marketing plans;
commercial strategies;
internal communications; and
other information that would reasonably be understood as confidential.
Hosts must not disclose or misuse HomeFans confidential information except where required by law.
This obligation continues after the Host relationship ends.
Hosts must not misuse customer information obtained through HomeFans for the purpose of improperly circumventing the platform.
During an active HomeFans booking, a Host must not encourage a customer to cancel or avoid the HomeFans booking in order to complete substantially the same transaction directly for the purpose of avoiding applicable HomeFans fees or protections.
Nothing in these Terms prevents a Host from operating an independent business or providing services through other lawful channels or platforms.
Hosts must communicate professionally with customers, HomeFans personnel and other platform users.
Threatening, discriminatory, fraudulent, abusive or seriously inappropriate conduct may result in platform action.
Hosts remain free to express lawful opinions and experiences.
However, Hosts must not knowingly publish false statements of fact about HomeFans, its customers, employees, other Hosts or business partners, misuse confidential information, impersonate HomeFans, or make representations they know they are not authorized to make.
Nothing in this section restricts lawful reporting to authorities, regulators, courts, professional advisers or other legally protected communications.
HomeFans may collect customer reviews, ratings, complaints and operational information to monitor service quality and improve the platform.
HomeFans may consider factors including:
customer ratings;
complaints;
cancellations;
response rates;
reliability;
booking fulfilment;
refunds;
safety incidents; and
compliance with these Host Terms.
Hosts may not manipulate reviews, pressure customers to remove legitimate complaints or submit fabricated reviews.
The visibility and ranking of Host listings may be influenced by factors including:
relevance to the customer's search;
location;
availability;
pricing;
customer ratings;
booking performance;
reliability;
cancellation history;
listing quality;
customer interest;
conversion;
service quality; and
compliance with HomeFans policies.
The relative importance of these factors may vary depending on the customer's search, location, event and other circumstances.
HomeFans does not guarantee any Host a particular position, volume of traffic, number of bookings or level of revenue.
Where HomeFans offers paid promotional placement or other mechanisms that materially affect ranking, the applicable conditions will be disclosed.
The Host authorizes HomeFans to market and distribute the Host's listing and service through HomeFans-controlled websites, applications, marketing channels, social-media channels, email marketing and other reasonable promotional channels.
HomeFans may also promote Host services through affiliates, partners, advertising channels or distribution partners where applicable.
The Host grants HomeFans a non-exclusive, worldwide, royalty-free licence for the duration of the relationship to use listing materials supplied by the Host, including photographs, descriptions, business names and approved branding, solely for operating, distributing and promoting the relevant service and the HomeFans platform.
Ownership of the Host's underlying intellectual property remains with the Host unless otherwise agreed.
During the relationship, Hosts may have access through HomeFans to certain information relating to their listings and bookings.
The exact information available may depend on the relevant platform functionality and applicable legal requirements.
HomeFans may have access to information supplied or generated through use of the platform, including:
listing information;
booking information;
customer communications through supported channels;
transaction information;
service-performance information;
reviews;
complaints; and
technical and platform-use information.
Access to personal data remains subject to applicable data-protection law and HomeFans' Privacy Policy.
A Host does not acquire ownership of HomeFans' customer database merely because the Host provided services to particular customers.
After termination, Host access to platform information may be restricted or discontinued, subject to applicable legal requirements. HomeFans may continue retaining information where reasonably necessary for legal, regulatory, tax, accounting, fraud-prevention, dispute-resolution, security or legitimate business purposes.
HomeFans may restrict a listing or suspend some or all Host platform activity where reasonably justified.
Grounds may include:
significant or repeated customer complaints;
failure to fulfil confirmed bookings;
repeated cancellations;
customers being unable to access booked services due to Host failures;
safety concerns;
suspected fraud;
misuse of customer information;
materially inaccurate listings;
abusive or threatening conduct;
serious reputational misconduct connected to use of the platform;
breach of confidentiality;
unlawful activity;
failure to maintain necessary licences or permissions;
payment or chargeback issues;
material breach of these Host Terms; or
repeated breaches of HomeFans standards or policies.
Where required by applicable law, HomeFans will provide the Host with a statement of reasons for a restriction or suspension on a durable medium.
Where appropriate, the Host will be given an opportunity to provide relevant information concerning the circumstances.
HomeFans may take urgent protective measures where reasonably necessary for customer safety, fraud prevention, cybersecurity, legal compliance or other circumstances in which immediate action is permitted or required by applicable law.
A Host may stop offering new services through Homefans subject to completing existing confirmed bookings and resolving outstanding obligations. Homefans may terminate the Host relationship where permitted by these Terms and applicable law.
Grounds may include serious or repeated breaches of these Terms, repeated service failures, fraud, serious safety issues, unlawful activity, repeated customer harm, material misuse of data or other circumstances making continuation of the relationship unreasonable.
Where applicable law requires advance notice or a statement of reasons, HomeFans will provide such notice or statement. Nothing in these Terms removes any right HomeFans may have under applicable law to terminate immediately where immediate termination is legally permitted.
Termination does not affect rights, obligations, claims or liabilities that arose before termination.
Following termination or suspension:
the Host may lose access to some or all platform functionality;
listings may be removed or made unavailable;
future unconfirmed bookings may be cancelled;
existing bookings may be cancelled or reassigned where reasonably necessary;
outstanding payment issues may be reconciled;
customer data must no longer be used except where legally permitted or required; and
provisions intended to survive termination will remain effective.
Termination does not require HomeFans to maintain indefinite platform access for the Host.
A Host who disagrees with a restriction, suspension, termination, payment adjustment or other material platform decision may contact HomeFans at: info@homefans.com
The Host should identify the relevant booking, listing or decision and explain the basis of the complaint.
Homefans will review complaints fairly and within a reasonable period.
Where applicable law requires additional complaint-handling or mediation procedures, HomeFans will make those procedures available.
Each party remains responsible for losses for which it is legally liable.
To the maximum extent permitted by applicable law, HomeFans is not responsible for losses caused by:
a Host's acts or omissions;
inaccurate information supplied by a Host;
failure by a Host to provide a confirmed service;
unlawful conduct by a Host;
third-party venue or event decisions outside HomeFans' reasonable control; or
circumstances outside HomeFans' reasonable control.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
To the extent permitted by applicable law, a Host will be responsible for reasonable losses, claims, costs and liabilities incurred by HomeFans as a direct result of:
the Host's material breach of these Terms;
the Host's unlawful conduct;
infringement of third-party rights by materials supplied by the Host;
misuse of customer personal data;
fraud or intentional misconduct; or
material failure to provide a confirmed service for which the Host was responsible.
Any claim under this section remains subject to applicable law, causation and reasonable mitigation of loss.
Hosts are responsible for determining whether insurance is legally required or reasonably appropriate for the services they provide. Where Homefans reasonably requires evidence of insurance for a particular type of service, the Host must provide valid evidence before offering that service.
Hosts are responsible for determining and meeting their own tax obligations arising from amounts earned through Homefans, except where applicable law requires HomeFans or a payment provider to collect, withhold or report particular amounts.
Homefans may collect and report Host identification, transaction and earnings information where required by applicable tax or platform-reporting legislation.
Homefans may amend these Host Terms from time to time.
Where required by applicable law, Homefans will notify affected Hosts of proposed changes on a durable medium and provide the legally required notice period before those changes take effect.
Changes will not be applied retroactively except where permitted or required by applicable law. Continued use of the platform after amended Terms take effect constitutes acceptance where permitted by applicable law.
These Host Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, their subject matter, or their formation shall be governed by and construed in accordance with the laws of England and Wales.
Subject to any mandatory rights or jurisdictional requirements that apply under applicable law, the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Host Terms, their subject matter, or their formation.
Before commencing legal proceedings, HomeFans and the Host are encouraged to make reasonable efforts to resolve any dispute in good faith.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law. A failure by Homefans to enforce a provision on one occasion does not constitute a waiver of that provision.
The Host may not transfer their Homefans account or obligations to another person without HomeFans' prior consent. Homefans may transfer its rights and obligations as part of a corporate restructuring, financing, merger, acquisition or sale of its business, subject to applicable law.
These Host Terms, together with the documents expressly incorporated into them, constitute the agreement governing the Host's use of the Homefans supplier platform.
